Sleeping on the Job?
DLP have seen an increase in queries, regarding Carers who sleep at a client’s home, seeking advice on whether they are entitled to minimum wage for these hours ‘worked’.
On the 13th July 2018 in the case of MenCap v Tomlinson-Blake, it was held by Court of Appeal that an employee was not entitled to National Minimum Wage whilst carrying out a sleep in.
The court used this opportunity to re-affirm the position laid down in previous cases.
